Accounts & Products

From time-to-time you may choose to purchase additional smartapp.com, an InQuest Technologies, Inc. (InQuest) property ( "we" or “our”), services or products ("Billable Products") for a fee. We accept payment through PayPal only (PayPal accepts Credit Cards and direct drafts from bank accounts – visit PayPal for more information) and will automatically charge your account one time, monthly or yearly, depending upon the Billable Product you purchase. If any fee is not paid in a timely manner, or We are unable to process your transaction via PayPal, We reserve the right to revoke or limit access to your smartapp.com Billable Products you have purchased.

Billing

The fees for your Billable Products that require monthly or yearly billing, will be collected from the date of purchase each monthly or yearly renewal thereafter unless and until you cancel your Billable Products. Visit the "My Products Catalog" page to see the commencement date for your next renewal period for your Billable Products. smartapp.com will automatically collect fees through PayPal each month or year on the calendar day corresponding to the commencement of your Billable Products. In the event your billing began on a day not contained in a given month or year, smartapp.com will collect fees on the last day of such month or year. For example, if your SmartApp Subscription began on January 31st, February 28th is the next time smartapp.com will collect your subscription fees (in non leap-years). You acknowledge that the amount collected each month or year may vary for reasons that include, differing amounts due to promotional offers, differing amounts due to changes in your account, or changes in the amount of applicable sales tax, and you authorize us to charge your PayPal account for such varying amounts. All fees and charges are nonrefundable and there are no refunds or credits for partially used periods. You should consult a tax professional to determine any potential sales or use tax liability.
smartapp.com may change the service fees and charges in effect, or add new service fees and charges from time to time, but before any change in service fees or charges are made, you will be required to approve them.
If you want to use a different PayPal account, you must contact smartapp.com immediately so we may take the proper steps to ensure uninterrupted service. Contact us at contactus@smartapp.com. If you need to make changes to your PayPal account, you must change your account information at PayPal. Changing your account settings on smartapp.com does not impact PayPal transactions’ success or failure – all changes to information with regards to payments must be made on your PayPal account. It is your responsibility to keep your contact information and payment information current and updated.

Upgrades

Should you elect to upgrade a Billable Product (for example, move to a larger amount of storage space), the commencement date for your next renewal period will be reset and you will be billed for the first month or year of the upgraded level immediately. For example, if you begin your monthly, billed storage on August 21st, your next payment would be due on September 21st. On October 15th, you upgrade your storage to a larger amount of space and would pay the new amount associated with the upgraded storage immediately minus a pro-rated credit on the first payment cycle of your upgrade.

Downgrades

Should you elect to downgrade a Billable Product (for example, move from a larger amount of storage space to a smaller amount), the downgrade will not take effect until the end of your current monthly or yearly payment cycle at which point you will be billed the new fee. For example, if you begin your monthly, billed storage on August 21st, your next payment would be due on September 21st. On October 15th, you downgrade your storage and would pay the new amount associated with the downgraded storage on November 21st – your next payment date. SMARTAPP.COM DOES NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL MONTHS OR YEARS.

Cancellations

Your smartapp.com account and Billable Products will continue in effect unless and until you cancel your account or Billable Products or we terminate them. You must cancel your account or Billable Products before they renew each month or year in order to avoid collection of the next month or year's fees from your PayPal account.
smartapp.com Billable Products are prepaid and are non-refundable. SMARTAPP.COM DOES NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL MONTHS OR YEARS. You may cancel your smartapp.com account and Billable Products at anytime, your account cancellation will be effective immediately. However, please note that you will not be issued a refund for the current payment cycle period or any previously charged monthly or yearly fees on your Billable Products.

Modifications

We may revise these Terms from time to time and the most current version will always be posted on our website. By continuing to access or use the Services after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to these Terms or the revised Terms, stop using the Services.
